Panovski to get new trial after successfully appealing murder conviction

The Ontario Court of Appeals has overturned the murder conviction of a man and ordered a new trial.

A three-judge appeal panel ruled that the jury in Boris Panovski’s trial was found to be inadequate, unbalanced, and therefore, unfair.

Panovski was 74 years old when he was found guilty of first-degree murder in the death of Don Frigo in 2018.

He was also found guilty of aggravated assault.

Frigo and his wife were at the Hullett Wildlife Area in Clinton in 2014 when the Toronto businessman was shot and killed, his wife was also shot but survived.

Prosecutors at the time believed Panovski had motive and opportunity.

Panovski’s lawyer filed an appeal one month after his client’s conviction citing a number of errors made in the trial.

A date for the new trial has not been set.
