Ontario judge rules against Bruce County on old rectory property

A provincial judge has found that the County of Bruce breached the trust of the Estate of Bruce A. Krug.

The ruling made by Ontario Superior Court Justice G.D. Lemon cites that the County used funds in the charitable trust fund to purchase the Southampton Rectory on High Street for the expansion of the Bruce County Museum and Cultural Centre.

The property was also the subject of a proposed new home of the Nuclear Innovation Institute which is now being housed at the old Saugeen Shores Police Service station.

The Southampton Cultural Heritage Conservancy filed an injunction against the County for what they say was the improper use of the funds.

In his ruling, Justice Lemon sided with the Conservancy.

Bruce County Warden Janice Jackson said in a statement that the County made a mistake in using the funds and are working towards a resolution with the public guardian and trustee, and estate trustee, in this litigation.
