Judge removes Bruce County as trustee of Krug Estate

The Ontario Superior Court has removed Bruce County as trustees for the Krug Estate Trust in a decision handed down earlier this week.

The case has been ongoing since 2019, when the Southampton Cultural Heritage Conservancy (SCHC) filed an application against the county, alleging they had breached the trust by using funds to purchase a former Anglican rectory (at 254 High St.) under the assertion that the property was a trust asset and not under county ownership.

The County was ordered to pay $140,000 to the SCHC this spring.

Justice G.D. Lemon wrote in his Oct. 12 decision “the County cannot be trusted to act appropriately with this property.”

Bruce County Council acknowledged they were in receipt of the decision and are currently reviewing it.

The SCHC says they agree with Justice Lemon on all counts and are satisfied that the legacy of Bruce Krug will now be respected.
